  • WJNCO Lawyers attended Shanghai International Shipping Law Forum, 2019

  • On 26 November 2019, the "Shanghai International Shipping Law Forum, 2019 " was held at East China University of Political Science and Law with a hundred more experts and scholars working in courts, universities, law societies, maritime arbitration commissions, insurance companies, law firms, etc. participated, jointly discussing on “The Trends of International Maritime Legislation and the Improvement of Chinese Maritime Law” and “The Development of Maritime Judicial Practice and the Improvement of Chinese Maritime Procedure Law”. The Firm's Managing Partner Mr. Chen Xiangyong and Partner Mr. Dai Yi were invited to attend the Forum.

    During the Forum, the Vice President of Dalian Maritime Court introduced controversial issues of concern encountered in their judicial practice arising out of carriage of goods by sea contracts regarding container demurrage, cargo claim, for which the gentleman also proposed amendment scheme; the Vice President of Ningbo Maritime Court addressed an in-depth speech interpreting thoroughly in aspect of maritime jurisdiction, ship arrest and auction, claim registration and distribution, etc.; the Presiding Judge from Shanghai Maritime Court also brought forward his opinions on amendment of Maritime Law and Maritime Procedure Law.

    Mr. Chen Xiangyong also delivered a speech with respect to the amendment of Maritime Procedure Law from the prospect of the unique characteristic of evidence involved in maritime claims, due to which, in Mr. Chen's view, the review of form of maritime evidence by the Court shall be more flexible than that of general civil claims and therefore the cross-examination shall play the core role in maritime claims. He also called for enabling the lawyers with the right of investigation as a matter of burden of proof, the according punishment rules shall be set to prevent incomplete or false evidence at the same time though.

    This Forum brought dozens of well-known experts and scholars studying in the field of international shipping law together with plenty of valuable insights and opinions produced.
